PRODUCT PURCHASE AGREEMENT

This PRODUCTS PURCHASE AGREEMENT is an official offer to conclude a contract for the purchase and sale of the products remotely, through the online store located at the address: https://hey-clay.com/shop, and, together with REFUND TERMS AND CONDITIONS, constitutes an unconditional binding agreement between You, a person placing an order through aforementioned online store, and the Seller, a respective legal entity specified in the section Country Specific Terms depending on the country of Products delivery.

1. Commencement and the term

When you are placing an order, whether on our website, using mobile application, or otherwise, you are unconditionally bound by this PRODUCTS PURCHASE AGREEMENT and REFUND TERMS AND CONDITIONS. If you do not agree on or accept any thereof mentioned documents, whether wholly or partially, do not place an order online.

2. Order Placement and Processing

To purchase the Products you should fill in and provide us all required information, choose a shipping service provider, and pay your order in full, together with applicable shipping costs, using our online platform, whether via our website or mobile application, and follow all instructions as provided on the platform depending on its functionality.

Order Placement. Your order placement shall be completed when you pay for it and we confirm that your payment has been processed successfully. Otherwise, you have not placed any order and we have no obligation to take any actions regarding such order. It is treated as unplaced, denied, cancelled and unacepted, etc.

Order Acceptance. Upon successful placement of an order, we will process it for up to 3 business days. If you do not receive any information about our inability to perform your order within that time, your order shall be treated as accepted.

3. Prices and Payments

Our websites, social media channels, other advertisements, mobile applications may contain the prices for the Products and in each such case such prices are for informational purposes only. Such prices may be changed from time to time without any additional notice of their upcoming changes or that any changes in prices have taken place.

An actual price for the Products to be paid is indicated in your order during its placement. When you pay your order upon completion order placement all prices set out in such order shall be final and binding and unchangeable.

All and any aforementioned prices for the Products, whether indicated on website, social media, mobile applications, in the chart during order process, or, finally, in the orders accepted, do not include any applicable import taxes, customs duties, any fees for customs clearance in the country of delivery, if there are any. These prices do not include any fees, costs, expenses connected with a delivery of the Products to the destination country or address, unless otherwise directly set out in an order accepted by us. You should check this by yourself before the placing an order to understand which additional costs you may bear in connection with placing an order or its delivery to you.

You are fully responsible for all customs procedures, payment all duties, taxes, fees which may be applicable to your order or parcel sent to you with items you ordered. We are not responsible for any parcels returned as a result of or in connection with unpaid duties, taxes, fees or your inability to pass through any customs formalities that may take place. You will not be also eligible to claim and/or receive any refunds in each such case. The payment methods you may use to pay for your order also depends on the country you are from or you chose as delivery address and it will be shown to your during the process of placing an order. You should pay the total amount of your order and shipping costs to complete an order process and make it eligible to our further review and acceptance. Otherwise your order shall not be place, or treated as placed, paid, accepted, and we are not obliged to process and review it.

You will not be charged any additional fees for processing your payments from our side, but you they may be imposed or charged by your bank, payment method you use, or payment service provider offering and processing payment method on your side (payment card issuer, payment card system, etc.).

Product prices may vary depending on the country or territory you are from or you chose as delivery address.

By this agreement or otherwise we inform you that, we do not responsible for any costs ans expenses mentioned above in this section of the Agreement, as well as hereby we do not provide any statements and/or guarantees of their absence or immateriality.

4. Order Shipment

All your orders placed with us will be delivered to you from different countries, depending on delivery address you provided while placing an order. It is at out sole discretion to choose the country from which your order will be delivered to you.

When you are placing an order and depending on the delivery address and country of delivery you will be provided with shipping service provider we are working with and who may deliver your order to your delivery address. We do not have physical shops, or collection points, due to that you have to choose the shipping service provider to complete your order. Otherwise you will be unable to complete, pay and place an order and we will be unable to accept it, deliver and sell the products to you.

Your shipping costs also depend on your delivery address and the shipping service provider you chose. The exact amount you should pay for the delivery of the Products will be indicated and shown to you before completion of order placement process. You may reject such costs and expenses by cancelling and not proceeding an order placement. You further placement of an order (completion of an order placement process) will constitute your acceptance and agreement on the price for the Products, shipping costs and any other import tax and customs payments you may be obliged to pay depending on the legislation of the country to which you order shall be delivered.

Our obligations to deliver an order shall be fulfilled on the moment when we hand over the Products you ordered to the respective shipping service provider you chose. The tracking number issued by such shipping service provider will serve as an evidence of performance of our obligations to deliver the Products.

We are unable to provide you with exact delivery time, as it is not under our control. It depends on shipping service provider you chose and other circumstances. Any delivery time you may or will see on our website, mobile application, when you are placing an order or on order details, or otherwise are estimated delivery provided for informational purposes only, and time that may be changed at any time, without any our obligations to comply with it.

5. Country Specific Terms

5.1 Who sells the Products to you

Depending on the shipping address you indicate when placing an order the Products will be sold and dispatched to you by one of our legal entity as follows:

We do not sell, deliver, dispatch, accept an order or even may make unavailable whole or part of our online stores (or respective functionality) to countries, which are under restrictions due to any applicable laws, rules and regulations, imposued by any country where we are operating. It includes, but not limited to, the following countries: Iran, Cuba, Syria, Sudan, North Korea and the Crimea region and other temporary occupied territories of the Ukraine, Republic of Belarus, Afghanistan, Russian Federation.
